These Terms of Use (“Terms”) govern your access to and use of the website www.meragyaansetu.com and related services (collectively, the “Platform”), operated by Mera Gyaan Setu, a non-profit organization registered in India (“Mera Gyaan Setu”, “MGS”, “we”, “us”, “our”). By accessing or using the Platform, you agree to these Terms and to our Privacy Policy.

If you do not agree, please do not use the Platform.

1) No Financial Returns / Not an Investment

  • Contributions made through the Platform are charitable in nature.
  • We do not offer any financial return (interest, dividends, profit share, securities, cash rewards, or equivalents).
  • Donations are not investments and should not be construed as such.

2) About the Platform & Our Role

  • MGS provides a Platform to:
    • share initiatives (educational aid, peer tutoring, cultural & skill activities, community drives),
    • enable donations for education-related needs,
    • publish updates and impact stories,
    • onboard volunteers/partners, and
    • host blogs and event information.
  • We may list fundraisers for our own programs or for vetted partner NGOs/beneficiaries.
  • We are not a broker, financial institution, or insurer. Transactions occur between Donors and MGS/beneficiaries/partner NGOs, as applicable.
  • We strive for transparency but do not guarantee that a specific campaign will reach a target or achieve a particular outcome.

3) Eligibility & Accounts

  • You must be able to form a legally binding contract under the Indian Contract Act, 1872.
  • Minors (under 18) may browse the site; however, account creation, donations, applications, or submissions must be performed by a parent/guardian or a registered organization on their behalf.
  • You are responsible for safeguarding your login credentials and for all activity under your account.

4) Donations, Payments & Receipts

  • Donations are processed via third-party payment gateways (e.g., UPI, cards, net-banking). Gateway terms and fees may apply.
  • We may deduct reasonable platform/processing costs (payment gateway charges, technology, outreach, verification) from donations before disbursal.
  • Upon successful payment, you’ll receive an acknowledgement/receipt by email/SMS.
  • Refunds: Donations are generally non-refundable. If a campaign cannot proceed or has surplus funds, MGS may reallocate to a similar education purpose; where reallocation is not feasible, we may process a refund at our discretion.
  • Tax benefits: If applicable under the Income Tax Act (e.g., 80G), we’ll issue receipts per law. Availability depends on our registration status and your accurate details (including PAN).

5) Campaigns, Disbursal & Monitoring

  • MGS reviews campaigns in good faith but information is often provided by campaigners/partners.
  • We may request documents for KYC/verification and may decline, suspend, or remove campaigns at any time.
  • Disbursal may be to:
    • the end-beneficiary (or their guardian),
    • a partner NGO/education institution, or
    • directly for fees, books, devices, or services (e.g., to a school/vendor).
  • We aim to share updates and impact stories, but timelines and results can vary.

6) Foreign Contributions

  • If we accept foreign donations, they will be handled in accordance with FCRA and other applicable laws.
  • We may decline or refund contributions that cannot be legally accepted.

7) Volunteering, Events & Tutoring

  • By applying to volunteer or tutor, you agree to our Volunteer Guidelines, event rules, and safeguarding practices.
  • Tutors/volunteers must follow child protection, anti-harassment, and safety policies.
  • For activities involving minors, parent/guardian/NGO consent and supervision protocols must be followed.
  • We may cancel or reschedule events or volunteer activities without liability.

8) Content You Share

  • “User Content” includes text, images, video, feedback, comments, or documents you upload or submit.
  • You represent that you own or have permission to use and share such content and that it does not violate any law or third-party rights.
  • You grant MGS a worldwide, non-exclusive, royalty-free license to use, reproduce, display, adapt, and distribute User Content for Platform operation, campaign promotion, and impact communication.
  • You agree not to post content that is illegal, defamatory, obscene, discriminatory, invasive of privacy, misleading, or harmful to children.

9) Images, Minors & Permissions

  • Do not upload images/video of children without informed consent of the parent/guardian/authorized NGO.
  • Avoid sharing personally identifying details (full names, exact addresses, sensitive medical details) unless essential and consented.
  • Images should be respectful and authentic; do not stage distress or manipulate images to mislead.

10) Prohibited Use

You agree not to:

  • engage in fraud, impersonation, or unlawful fundraising,
  • interfere with Platform operation (spam, scraping, hacking),
  • infringe IP or privacy rights,
  • solicit users for unrelated commercial purposes,
  • upload malware or harmful code, or
  • violate any applicable laws (including IT Act, PMLA, FCRA, Income-tax, RBI/AML directions).

11) Intellectual Property

  • The Platform, logo, graphics, code, and content created by MGS are our intellectual property.
  • You may not copy, modify, distribute, or create derivative works without written permission.
  • Third-party names and logos are the property of their respective owners.

12) Communications & Consent

  • By using the Platform, you consent to receive service communications (email/SMS/WhatsApp/app notifications) regarding donations, events, volunteering, and updates.
  • You can adjust communication preferences where available; essential service messages may still be sent.

13) Third-Party Links & Services

  • We may link to third-party sites or use third-party services (payment gateways, analytics, forms).
  • We are not responsible for third-party content, policies, or practices.

14) Privacy

  • We respect your privacy. Please review our Privacy Policy to understand how we collect, use, store, and share data.

15) Disclaimers

  • The Platform and its content are provided “as is” and “as available.”
  • We do not guarantee uninterrupted service, error-free content, fundraising targets, or specific outcomes.
  • To the fullest extent permitted by law, we disclaim all warranties, express or implied.

16) Limitation of Liability

To the maximum extent permitted by law, MGS and its officers, trustees, employees, and volunteers shall not be liable for indirect, incidental, special, or consequential damages. Our total aggregate liability for any claim shall not exceed INR 2,000 or the amount you paid to MGS for the service giving rise to the claim in the last six (6) months, whichever is higher.

17) Indemnity

You agree to indemnify and hold harmless MGS and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your:
(i) use of the Platform, (ii) breach of these Terms or laws, (iii) violation of third-party rights, or (iv) misuse of donations or content.

18) Changes to the Terms

We may update these Terms from time to time. Changes will be effective upon posting on the Platform with the “Last updated” date. Continued use constitutes acceptance.

19) Suspension / Termination

We may suspend or terminate access (temporarily or permanently) if we believe you breached these Terms or applicable law, or to protect users/beneficiaries.

20) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Courts at Faridabad, Haryana shall have exclusive jurisdiction.
  • We may opt for arbitration by a sole arbitrator in Faridabad, under the Arbitration and Conciliation Act, 1996; proceedings in English.

22) Entire Agreement & Miscellaneous

These Terms, together with our Privacy Policy and any campaign-specific rules, constitute the entire agreement between you and MGS. If any provision is held invalid, the remainder remains enforceable. You may not assign your rights without our consent.
